GrailScout Terms of Service

Please read these Terms of Service (“Terms”) carefully before using GrailScout.

GrailScout (“GrailScout,” “we,” “our,” or “us”) is a collectibles tracking app built first for diecast collectors. These Terms govern your access to and use of the GrailScout mobile app, website, services, features, content, and related tools (collectively, the “Service”).

By creating an account, downloading, accessing, or using GrailScout, you agree to these Terms and our Privacy Policy. If you do not agree, do not use GrailScout.

1. Beta Status

GrailScout may be offered as a beta, early-access, preview, or test version.

During beta, the Service may include bugs, incomplete features, inaccurate data, missing functionality, downtime, changes, or errors. Features may be added, removed, changed, limited, reset, or discontinued at any time.

You understand and agree that beta use is at your own risk and that GrailScout should not be relied on as a final, complete, or error-free product.

2. Eligibility

You must be at least 13 years old to use GrailScout.

If you use GrailScout on behalf of another person, business, or organization, you represent that you have authority to accept these Terms on their behalf.

You are responsible for complying with all laws, rules, and third-party terms that apply to your use of GrailScout.

3. Accounts and Security

To use certain features, you may need to create an account.

You agree to provide accurate account information and keep it updated. You are responsible for maintaining the security of your account, device, login credentials, and app access.

GrailScout may support device-based app-lock features such as Face ID, Touch ID, Android biometrics, device passcode, or device unlock. These features are provided for convenience and added security, but you remain responsible for protecting your device and account.

You must notify us promptly if you believe your account has been accessed without permission.

4. Your Collection Data and User Content

GrailScout allows you to save and manage information such as collection items, Grails or wishlist items, Hunting Grounds, saved locations, notes, target prices, conditions, estimated values, images, and related app data (“User Content”).

You are responsible for the User Content you add to GrailScout.

You represent that you have the rights needed to upload, save, or use any content you add to GrailScout, including images, notes, descriptions, or other materials.

You retain ownership of your User Content. By using GrailScout, you grant us a limited license to store, process, display, back up, transmit, and use your User Content only as needed to operate, support, protect, and improve the Service.

Do not upload or save content that is unlawful, infringing, abusive, harmful, misleading, or that you do not have the right to use.

5. Collectible Values, Market Data, Estimates, and Confidence Signals

GrailScout may provide estimated values, market context, listing information, pricing signals, confidence indicators, A.R.T.S. signals, recommendations, and related collectible information.

All values, recommendations, signals, confidence indicators, and market information are estimates only. They are not guaranteed appraisals, certified valuations, financial advice, investment advice, professional valuation advice, authentication guarantees, or promises of what an item will buy or sell for.

Collectible values can change quickly and may be affected by condition, rarity, packaging, demand, location, seller reputation, fees, shipping, taxes, timing, marketplace availability, and other factors.

GrailScout may include automated, algorithmic, AI-assisted, or confidence-based outputs. These outputs may be incomplete, incorrect, outdated, or based on limited available data. You should independently verify item identity, condition, authenticity, market value, and pricing before making buying, selling, trading, or collecting decisions.

GrailScout is intended as a collector organization and market-reference tool. It is not intended to replace professional appraisal, expert authentication, financial advice, investment advice, or independent research.

You are responsible for your own buying, selling, collecting, trading, pricing, valuation, and authentication decisions.

6. Third-Party Data, APIs, Marketplaces, and Reference Sources

GrailScout may use, reference, display, process, or link to third-party marketplaces, listing data, APIs, reference sources, community-maintained information, user-entered information, or other sources to support item identification, market estimates, search, links, images, or confidence signals.

Third-party data may be incomplete, delayed, inaccurate, unavailable, outdated, misclassified, or subject to change.

We do not control third-party services, marketplaces, websites, APIs, listings, prices, sellers, buyers, images, item descriptions, reference sources, or market conditions. We are not responsible for third-party content, errors, outages, policies, decisions, prices, listings, or transactions.

Links to third-party websites, marketplaces, listings, or reference sources are provided for convenience only. Your use of third-party sites or services is governed by their own terms, policies, fees, and practices.

7. No Affiliation, Sponsorship, or Endorsement

GrailScout is an independent app.

Unless expressly stated in writing, GrailScout is not affiliated with, sponsored by, endorsed by, authorized by, licensed by, approved by, or officially connected to any collectible brand, manufacturer, marketplace, database provider, reference source, rights holder, media company, game company, toy company, trading card company, or third-party service.

This includes, but is not limited to, Mattel, Hot Wheels, Matchbox, Funko, LEGO, Nintendo, Creatures Inc., GAME FREAK inc., The Pokémon Company International, Pokémon, eBay, Fandom, hobbyDB, Toy Car Value, and their respective parents, subsidiaries, affiliates, licensors, licensees, partners, rights holders, and related companies.

All trademarks, service marks, product names, brand names, logos, characters, images, trade dress, copyrights, and other intellectual property belong to their respective owners.

References to third-party brands, products, marketplaces, characters, item names, series names, categories, reference sources, or services are used only for identification, compatibility, organization, collecting, search, market-reference, or informational purposes.

GrailScout does not claim ownership of any third-party trademarks, brands, characters, images, logos, product names, listings, descriptions, reference data, or intellectual property.

GrailScout does not imply that any third-party brand, marketplace, database provider, reference source, or rights holder has reviewed, approved, sponsored, endorsed, licensed, authorized, verified, or certified the Service.

8. GrailScout Intellectual Property

GrailScout, including the app name, design, logo, branding, software, code, layout, visual style, text, features, workflows, graphics, icons, and related materials, is owned by us or our licensors and is protected by intellectual property and other laws.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, scrape, extract, reproduce, create derivative works from, or misuse any part of GrailScout unless we give you written permission or the law allows it.

You may not use GrailScout’s name, logo, branding, visual identity, screenshots, or materials in a way that suggests affiliation, sponsorship, endorsement, or approval without our written permission.

9. Acceptable Use

You agree not to:

  • use GrailScout for unlawful, harmful, fraudulent, abusive, or infringing activity
  • access or attempt to access another user’s account or data
  • interfere with, disrupt, overload, or damage the Service
  • bypass security, authentication, account limits, or access controls
  • scrape, crawl, harvest, extract, copy, or bulk-download data from GrailScout without permission
  • reverse engineer, decompile, or attempt to derive source code from the app
  • upload malicious code, viruses, or harmful content
  • use GrailScout to violate third-party rights, terms, licenses, or policies
  • upload third-party images, descriptions, logos, or content you do not have the right to use
  • misrepresent collectible values, ownership, condition, authenticity, rarity, or identity
  • use automated tools to abuse, overload, manipulate, or interfere with the Service
  • use GrailScout outputs as the sole basis for high-value purchases, sales, trades, investments, appraisals, authentication decisions, or commercial inventory decisions
  • represent GrailScout estimates, confidence signals, recommendations, or market data as official, certified, guaranteed, professionally verified, or appraised valuations
  • use GrailScout in a way that could harm users, collectors, marketplaces, brands, rights holders, or the Service

We may suspend or terminate access if we believe these Terms are violated or if access creates risk to GrailScout, users, data, systems, third-party services, or rights holders.

10. Payments, Subscriptions, and Fees

GrailScout may be free during beta or early access.

We may introduce paid features, subscriptions, in-app purchases, founder plans, premium plans, or other fees in the future.

If paid features are introduced, pricing, billing terms, renewal terms, cancellation terms, and refund rules will be presented clearly before purchase.

Payments may be processed by Apple, Google, RevenueCat, Stripe, or another payment provider. Payment transactions may be subject to the terms and policies of the applicable payment provider.

We may change pricing, features, plan limits, or availability from time to time, subject to applicable law and app-store rules.

11. App Updates, Changes, and Availability

We may update, change, suspend, limit, or discontinue GrailScout or any feature at any time.

We do not guarantee that the Service will always be available, uninterrupted, secure, accurate, complete, current, or error-free.

Some features may require internet access, app updates, device compatibility, third-party API availability, account access, app-store availability, or service-provider availability.

You are responsible for any data charges, mobile carrier fees, internet fees, roaming charges, or device costs that may result from using GrailScout.

We recommend keeping your device, operating system, and app version updated. Modified, jailbroken, rooted, or unsupported devices may reduce security, reliability, or app functionality.

12. Account Deletion and Termination

You may stop using GrailScout at any time.

You may request deletion of your account and associated data by contacting: [email protected]

You may also use any account-deletion option provided in the app or on grailscout.app.

Uninstalling the app may remove local data from your device, but it may not automatically delete account data stored on GrailScout’s systems.

We may suspend or terminate your access to GrailScout if we believe you violated these Terms, created risk to the Service or other users, or used the Service in a harmful, abusive, infringing, or unlawful way.

After termination, your right to use GrailScout ends immediately.

13. Feedback

If you send us ideas, suggestions, bug reports, comments, screenshots, feature requests, or other feedback, you agree that we may use that feedback to improve GrailScout without owing you compensation, credit, ownership, or approval.

You agree not to submit feedback that includes confidential information you do not want us to use.

14. Disclaimers

GrailScout is provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, and error-free operation.

We do not guarantee that item identification, market data, estimated values, confidence signals, search results, images, links, third-party data, third-party services, or reference information will be accurate, complete, current, available, or suitable for your needs.

You use GrailScout at your own risk.

15. Limitation of Liability

To the fullest extent permitted by law, GrailScout and its owners, operators, affiliates, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost opportunity, lost collectibles, lost value, purchase decisions, sale decisions, trading decisions, pricing decisions, authentication decisions, appraisal decisions, or reliance on estimated values, confidence signals, recommendations, third-party information, or market data.

To the fullest extent permitted by law, our total liability for any claim related to GrailScout will not exceed the greater of:

  • the amount you paid to use GrailScout in the three months before the claim, or
  • $100

Some jurisdictions do not allow certain limitations of liability, so some limits may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless GrailScout and its owners, operators, affiliates, service providers, and partners from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney fees, arising from or related to:

  • your use or misuse of GrailScout
  • your User Content
  • your violation of these Terms
  • your violation of another person’s rights
  • your violation of law
  • your violation of third-party terms, policies, licenses, or rights
  • your buying, selling, trading, collecting, pricing, valuation, authentication, or appraisal decisions

17. Third-Party Terms

Your use of third-party services, marketplaces, APIs, payment providers, app stores, authentication providers, or reference sources may be subject to separate terms and policies.

We are not responsible for third-party terms, privacy practices, fees, outages, content, listings, transactions, values, images, descriptions, or decisions.

18. Privacy

Your use of GrailScout is also governed by our Privacy Policy, available at: grailscout.app/privacy-policy

The Privacy Policy explains how we collect, use, share, retain, and protect information.

19. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may notify users through the app, by email, or by posting an updated version on grailscout.app.

The updated Terms will be effective when posted unless otherwise stated.

Your continued use of GrailScout after updated Terms become effective means you accept the updated Terms.

20. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.

You agree that any dispute related to GrailScout or these Terms will be handled in the state or federal courts located in Florida, unless applicable law requires otherwise.
